Although Immigration New Zealand will accept EOIs with 100 or more points, we expect the passmark
will fluctuate. When we assess your enquiry, we will check it against the current passmark and against
our expectation for future passmarks and advise accordingly in our reply to you.
It should be noted that when an EOI is drawn from the pool, the visa officer will invite an application
for residence based on the information in the EOI.
The decision of the visa officer whether or not to invite an application for residence will be
based on a number of criteria including the points claimed. Although some of the selection criteria
will be identified, other criteria will be subjective and intending applicants should take considerable
caution to ensure that whatever is stated in their EOI does not compromise their chance of being selected
from the pool. You should also be aware that the legislation specifically denies any right to a reconsideration
or appeal of a decision to not invite an application for residence.
When lodging an application for residence, any variation from the EOI may be considered by Immigration New Zealand
to be fraud.
Because of the highly complex nature of the SMC process, professional advice should be sought to
minimise the risk of inadvertently compromising the application.
